Ballard Business Recovery Limited does not sell, share or transfer this information except as set out in this Privacy Notice.

How we collect information from you
We obtain personal data about you when we use our website, or directly agree or register to receive our Newsletter or a technical release or you have agreed to receive information about an event we are hosting. We also collect and hold personal data where there is a legal obligation to do so from information provided by third parties.
What type of personal data is collected from you
The type of personal data that we collect about you will generally include personal information such as name, postal address, email address, telephone numbers, company name, job title, profession. If our clients held personal data, we will also seek to take control of this data upon our appointment in any insolvency procedure. If this data is not required to be maintained for the purpose of our instruction, it will be destroyed.
Specifically data is collected for the following parties as follows:
Employees – In order to fulfil our statutory responsibilities we often collect personal data for employees including their names, addresses, national insurance number, contact details and payroll data. This data is used to calculate statutory entitlements due to those employees as a result of the insolvency of our clients. This data is shared with the Redundancy Payments Service who are responsible for the adjudication and payment of employee claims.
Additionally insolvency legislation dictates that employee names, addresses and total estimated claims must be included within a statement of affairs that is circulated to creditors. This data is removed before uploaded the statement of affairs at Companies House, in accordance with insolvency legislation. In special circumstances, such as a possible threat of violence towards the individual should their personal details be disclosed to creditors, we may remove personal contact details from the statement of affairs before issuing a copy to creditors. This is to be considered on a case by case basis.
Creditors – We we collect details of creditors of our clients including names, addresses, invoices, references, correspondence with our clients and amounts owed. This is in order to fulfil our statutory obligations to notify creditors of our engagement or appointment. Creditor names, addresses and amounts owed will be included in the documentation made available in the public domain, such as Companies House.
Additionally insolvency legislation dictates that consumer creditor names, addresses and total estimated claims must be included within a statement of affairs that is circulated to creditors. This data is removed before uploaded the statement of affairs at Companies House, in accordance with insolvency legislation. In special circumstances, such as a possible threat of violence towards the individual should their personal details be disclosed to creditors, we may remove personal contact details from the statement of affairs before issuing a copy to creditors. This is to be considered on a case by case basis.
We may also ask creditors to provide their bank account details to facilitate the payment of any dividends. This information is confidentially stored at our offices and not released to any third party.
Parties interested in assets – If any party contacts us expressing an interest in acquiring the assets of one of our clients, we shall only use their details for the purpose of that case. Ballard Business Recovery does not maintain a data base of parties who are generally interested in acquiring assets from insolvent estates and will generally provide your contact details to our independant agents who will manage the asset disposal position on our behalf.
How we will use your personal data
We may use personal data held about you to enable us to comply with our legal obligations in respect of cases we are dealing with or to comply with employment legislation, to process any request or enquiry you make and with agreement, to provide you with technical information or details about products or services that we think may be of interest to you.
We may share your personal data with third parties. We will only share personal data where there is a legal requirement to do so or when we consider it is necessary.
Future Communications
From time to time we may wish to send you information about products and services we believe may be of interest to you if you have consented to receive this information. Use of Our Website
It is not necessary for you to register with us in order to access the Website. However we may collect some personal data from interactive features such as online surveys, contact and registration forms. The basic personal data about you which we may collect and process is: your name, your user type, your e-mail address, your user ID and password.
Depending on what you are registering for, additional personal data may be collected from you. We may also collect and process personal data provided by you at the time of posting material to our Website, as well as details of your visit to the Website (including, but not limited to, traffic data, location data, weblogs and other communication data), and the resources that you use. Further, if you contact us, we may also keep a record of that correspondence.

Google Analytics sets or updates cookies only to collect data required for the reports. Additionally, Google Analytics uses only first-party cookies. This means that all cookies set by Google Analytics for our website send data only to the servers for our website. This effectively makes Google Analytics cookies the personal property of our website, and the data cannot be altered or retrieved by any service on another website or domain.

Security and Storing of Personal Data
We will use all reasonable efforts to securely store your personal data that we collect about you.
We review our retention periods for personal data on a regular basis. We will hold any personal data about you only for as long as is necessary to fulfil the purposes for which such data was obtained. We are legally required to hold some personal data to fulfil our statutory obligations for specific periods. Where there is a legal requirement to hold personal data; (1) in respect of data relating to a case that we have dealt with, personal data will be held for a period of six years from the date of ceasing to act in respect of such cases (2) where there is personal data obtained from one of our clients in accordance with our duties that form part of that clients books and records, the data will be destroyed 12 months following the dissolution of the client company, and (3) in respect of employees’ personal data will be held for a period of two years from employment ceasing or application for employment was received.
Correction to personal data and access
You have a right to request details about the personal data we hold about you. You can request a copy of the personal data we hold about you or ensure that your personal data is correct by emailing office@ballardbusinessrecovery.co.uk or by writing to Ballard Business Recovery Limited, 21A Bore Street, Lichfield WS13 6LZ.
You also have the right:
· to object to processing that is likely to cause or is causing damage or distress;
· to prevent processing for direct marketing;
